DACA Program Background

DACA stands for the Deferred Action for Childhood Arrivals program. The legislation protects undocumented immigrants, called dreamers, who entered the country as minors from deportation for a specific time frame. Applying requires that you meet particular qualification guidelines.

If the United States Citizenship and Immigration Services, or UCIS for short, approves the application, they grant temporary deportation protection, allowing you to work in the country legally. The law offers dreamers a sense of security and opportunities.

However, the legislation faces ongoing legal challenges, and while renewals are open, the approval for new applications is currently on hold. A Charlotte DACA attorney understands your struggles, could offer advice and guidance, and help you with the application.

The DREAM Act Bill

The Development, Relief, and Education for Alien Minors Act, or DREAM, seeks to help immigrants and benefit the U.S. economy by allowing them to contribute to the communities in which they reside. The Dream Act Bill aims to provide a pathway to citizenship for qualified undocumented individuals who arrived in the U.S. as children. Approval for DACA prevents deportation for two years, allowing the immigrants to obtain work permits for two years.

Upon expiration, those who exhibit good behavior in that period can apply for renewal. While some U.S. representatives have called the legitimacy into question and approval under the program is on hold, the UCIS is still reviewing applications, and renewals remain open. Those requesting approval under the program must meet specific criteria.

Qualifications for the Deferred Action Program

Eligibility requirements for the deferred action immigration program include the following:

  • The individual was born on or after June 16, 1981
  • They must be over 15 and have entered the United States before their 16th birthday
  • They have lived and been physically present in the U.S. continuously since June 15, 2007
  • They have no legal immigration status at the time of application, and if they had immigration or parole status previously, it expired before June 15, 2007
  • If the individual obtained immigration status after June 15, 2007, it must have expired before the date of the request for DACA
  • Current enrollment in school at the time of request or honorably discharged from the U.S. armed forces, or they previously optioned a high school diploma or a General Education Development (GED) certificate
  • They have no convictions for a felony or serious misdemeanor on their criminal record or pose a threat to national security

A DACA lawyer in Charlotte could review the guidelines and help you determine if you meet the qualifications to submit a request during a consultation. They could also assist with the renewal process.
